Since my video's are commentated, they are protected under the fair use law due to the entertaining and educational nature.What I upload is completely fair use and does not violate any of YouTube's Polices or Terms of Service. This allows me to provide video game, content as long as it is commentated, without having to acquire the copyright owners permission.

It is not entirely accurate. Minecraft is fine, Black Ops is a different story, but you can only claim fair use in court. Without documented fair use ruling by the courts, if a 3rd part strike is placed against your video, and you claim fair use on the dispute form, they can close your account without it, and retrieve any money they've paid you on your account. You have no idea if a court will rule that your content has fallen in the terms of fair use. Monetizing videos isn't all it's cracked up to be, and 90% of the time, youtubers are wrong and provide other's with false information.
